The firm is experienced in all facets of family law and domestic relations. We have litigated and mediated hundreds of divorce cases (known in Florida as “dissolutions of marriage”), both large and small, with long-term and short-term marriages, involving no children or many children, and involving thousands of dollars to millions of dollars in assets and liabilities. Divorce cases typically involve some or all of the following: · Alimony. Based upon factors such as length of the marriage, earning capacities of the spouses, health of the spouses, and lifestyle of the marriage, one spouse may have the greater need for financial support and the other spouse may have the greater ability to pay that support. The monthly contribution from one spouse to the other is alimony, and it may continue for a specific period of time or indefinitely, terminating upon events such as death or remarriage.
· Child Custody and Visitation. The parties may have very different roles in the raising of their children. We negotiate and litigate such issues as sole custody, shared parental responsibility, joint custody, rotating custody, and visitation schedules.
· Child Support. The amount of child support one parent pays to another is not random. It is based upon a formula that considers gross income, net monthly income, health insurance, and child care costs and, sometimes, summer camp, private school and the children’s special needs. Child support also can be affected by tax issues, such as dependency exemptions, determination of head of household status, and the amount of time-sharing each parent spends with the children.
· Contempt and Collection of Unpaid Support. We handle collection of unpaid alimony and child support, including enforcement through contempt proceedings, garnishment of wages, and suspension of driver’s licenses.
· Distribution of Property. The assets and liabilities of the parties must be valued and allocated between the parties. Special attention is given to tax issues, whether the assets are liquid or not, the nature of real estate holdings, and income generated from assets. We also look at how the assets and liabilities were acquired to determine whether they should be allocated only to one party or divided on other than a 50/50 basis.
· Post-Divorce Modifications. After the divorce is over, events substantially can alter the circumstances of the parties and the children. We initiate and defend actions for modification of alimony, child support, and child custody and visitation, including attempts by one parent to relocate with the children to another area or state.
· Prenuptial and Postnuptial Agreements. Many problems can be averted by the careful drafting of agreements that cover issues of death and divorce. These agreements allow parties to solve potential disputes before those disputes become reality.
